User Agreement

(Terms of Use of the Site)

This Agreement defines the terms and rules of use of the site FAIRYCHEST.ART (hereinafter - the Site) for the intended use of the Site and user access.

The Agreement is concluded between you (hereinafter - the User) and the Administration of the Site (hereinafter - the Administration) and regulates all ways of using the site, its "sub domains" and programs, which are at the disposal and in the management of the Administration, all types of services provided by the Administration with the help of the site and Programs.

1. General Provisions

1.1 The site (hereinafter - FAIRYCHEST.ART) provides users with a wide range of services related to the field of law (hereinafter - Services).

1.2 Services are provided to Users of the site FAIRYCHEST.ART in accordance with this User Agreement (hereinafter - the Agreement).

1.3 The use of the Site indicates the User's adherence to this User Agreement (hereinafter - the Agreement) in full and confirms his agreement with the terms and conditions below.

1.4 The use of the Site is authorized only to a person who has accepted all the terms and conditions of this Agreement.

1.5. The User must carefully read the terms of this Agreement before using the Site.

1.6 If you do not agree with the terms of this Agreement (in whole or in part), then the rights of the user can not be granted, you are also prohibited from using the Site, including, but not limited to, any information posted on the Site and any Services provided within the Site.

1.7 The terms and conditions defined in this Agreement apply to all Users of the Site.

1.8. This Agreement is a contract of adhesion in accordance with Article 634 of the Civil Code of Ukraine. By visiting our site and working with its content, you fully accept the terms of this Agreement, confirm your familiarization with them and assume obligations to comply with them.

2. Definition of Terms

2.1 Administration - (owner of the site) performs certain administrative functions to control the performance of the site, server, equipment and programs on which the site is located, is engaged in the "promotion" of the site, keeps statistics of attendance, performs the duties of content manager, monitoring the timely updating of information.

2.2 User - any person, including both citizen of Ukraine and citizen of a foreign country, using the site.

2.3. User Agreement - this agreement, as well as all subsequent amendments and additions to it.

2.4 Information on the Site - any information placed on the Site, including information (messages, data) regardless of the form of their presentation, results of intellectual activity, as well as other data, in accordance with the legislation of Ukraine. The use of information on the Site by any means is allowed only subject to the restrictions established by the current legislation of Ukraine, this Agreement and the license agreement on granting the right to use the Site, which will be submitted to the user's request.

2.5 Information messages - any information that does not contradict the legislation of Ukraine, which may be provided to Users for informational purposes only.

2.6. Site - a set of web pages placed in the Internet, united by a single theme, design and a single address space of the FAIRYCHEST.ART domain, containing information on the Site, which is created, collected or processed by the Administration and Users, contained in an information system that ensures the availability of such information in the Internet at the network address FAIRYCHEST.ART.

2.7 Use of the site - authorized by this Agreement to use the site for its functional purpose, in particular, downloading pages of the site and use of its resources and services.

2.8. Partners - any natural or legal persons connected with the Administration by contractual relations, who are granted the right to post on the site information that does not contradict the law and the purposes of the site, as well as whose Information messages (including Information messages made public on their behalf or in their interests) can be displayed and / or sent to Users.

2.9 Cookie - a piece of data generated by the Site and stored in the user's computer (browser) in the form of one or more files. Cookie does not contain personal data and can be blocked by the User at any time.

3. Subject of the Agreement

3.1 Administration allows users to view and download information from the site for personal non-commercial use. It is forbidden to modify materials from the site or distribute them for any other purpose. Any use of information from the site on other sites, resources or computer networks is prohibited.

3.2 The information and services that the User receives through the site are provided only for the purposes provided for in this Agreement.

3.3 The information and services that the User receives through the site may be used by the User in professional activities, but the responsibility for further dissemination of information from the site or its consequences entirely belongs to the User.

3.4 In accordance with this Agreement, the User warrants that use the Site in its professional activities for informational purposes only.

3.5 Users are solely responsible for the evaluation and their own perception of information obtained from the site, and the use or misuse of such information at their own discretion.

3.6 Users are responsible for compliance with the laws of Ukraine and standards of professional practice.

3.7 The site may contain links to other websites or partner resources. Administration is not responsible for such websites and resources, in particular, their availability, as well as the legality, completeness and correctness of the information distributed on them.

4. Rights and obligations of Users and Administration

4.1. The User and the Administration when using the Site undertake to comply with the current legislation of Ukraine and the following rules.

4.2 User's Rights and Obligations

4.2.1 The User may use the Site exclusively within the limits of those rights and in those ways, which are established by this Agreement and other rules, which are placed by the Administration of the Site.

4.2.2 The User has the right to use the Site and access to the posted information. The Administration at its discretion determines the conformity of information, has the right to delete inappropriate information without prior notice to the User - it is prohibited to post information that violates the rights of third parties to information or the results of intellectual activity. This restriction is understood as a ban on copying any information without the consent of the right holder; - it is allowed to quote in the original and in translation for scientific or informational purposes of lawfully publicized works, including reproduction of excerpts from newspaper and magazine articles in the form of press reviews, in the amount justified by the purpose of quoting, but not more than a quarter of the author's text of the publication.

4.2.3 The user is prohibited to:

- forge headlines to carry out other manipulations to circumvent the restrictions established for access to the Site;

- attempt to circumvent any protective technological measures related to the use of the Site

- send, upload, transmit or otherwise distribute traffic influencing tools, as well as "chains, pyramids," advertisements or spam;

- disclose or disregard affiliation with a third party or organization;

- collect information about other users, including personal and contact information;

- use the Site to conduct business or any activity aimed at generating income (except for actions provided for in separate agreements between the User and the Site)

- upload, store, publish, distribute and provide access to or otherwise use the intellectual property of other Users and third parties, without legal rights to such use;

- upload, store, publish on the Site information from other Internet resources, as well as copy, distribute and provide access to information on the Site to third parties who are not users of the Site

- download, store, publish, distribute and provide access to and otherwise use viruses and any other malicious programs;

- post information and objects that may violate the rights and legitimate interests of third parties, as well as information that contains threats, discredits, insults, humiliates honor and dignity or business reputation or violates the privacy of users, third parties, Administration; - use the Site for other purposes, instead of defined by this Agreement.

4.3 Rights and obligations of the Administration

4.3.1. Administration has the right, but is not obliged to do any further actions without warning:

- record or preview materials for Users in any areas of the Site

- study the statistics of the Site usage

- delete the content of the User's publications, which, in the opinion of the Administration, does not comply with this Agreement and / or license agreement;

- stop and restrict access of the user who violated the terms of use to the Site

- establish new terms of use of the Site

- determine the content of the Site, information contained on the Site, Services provided to Users;

- use personal data of the User by any means stipulated by the legislation of Ukraine to improve the work of the Site.

4.4 The Administration undertakes to:

- be impartial in making decisions on the actions of Users;

- maintain the Site in working condition;

- to take the necessary organizational and technical measures to protect personal data of Users from unauthorized and illegal or accidental access to them, destruction, distortion, blocking, copying, distribution of personal data; - to comply with the privacy policy of the site, which can be viewed on request to the administration;

- in case of provision of personal data of the user in accordance with the requirements of the legislation of Ukraine on the protection of personal data and the Terms of Use of the site, to monitor the legality of their use.

5. Disclaimer of warranties

5.1 Administration does not guarantee that the Services on the Site meet the personal expectations and requirements of Users and / or unconditionally bring the result expected by the user.

5.2 Administration shall not be liable to users and third parties for possible consequences of their use of the Site.

5.3 Administration is not responsible for the accuracy of the information posted by Partners and other Users.

5.4 Users agree that they use the Site at their own risk and under their own responsibility.

5.5. Administration is not responsible for any damages (including, loss of money, loss of connections or reputation, potential profits, other intangible losses, any special or consequential damages) caused including, but not limited to due to: - misunderstanding by the user of the order of use of the Site, information on it, interpretation of information at its discretion or inability to use the Site in full; - errors or inaccuracies in the content; - delays or failures in our services; - errors or inaccuracies of any kind in the Services on the Site; - errors or inaccuracies in the Site; - errors or inaccuracies of any kind.

5.6 Administration is not responsible for damage to your computer equipment or other property, as well as possible infection of them with viruses, loss of data as a result of your visit to the site, use of the Site and information, downloading of information by you, and shall not be liable in connection with the above. Administration reserves the right to discontinue this site at any time without notice and shall not be under any obligation in connection therewith.
